The ARRA has created challenges for HIPAA covered entities and business associates to implement policies for breach notification and accounting of disclosures of PHI.  Because almost all states have adopted their own notification provisions that have requirements different from HIPAA and HIPAA does not pre-empt more restrictive state requirements, covered entities will have to establish policies that comply with all applicable requirements. ARRA has also expanded the obligations regarding accounting of disclosures to individuals that cover essentially all disclosures made during the three years preceding a request.
