On March 9, 2020, the Office of the National Coordinator for Health IT (ONC) announced the release of the 21st Century Cures Act: Interoperability, Information Blocking, and the ONC Health IT Certification Program Final Rule. The new final rule details a new legal prohibition on “information blocking.” Information blocking aims to encourage greater information sharing and interoperability across healthcare stakeholders, including providers, developers of health IT, health information networks and exchanges. The rule primarily focuses on enabling data sharing, but there are exceptions for privacy and security and healthcare organization will need to understand how to balance these competing interests.
