This session will explore how EHRs have affected how medical malpractice cases are handled and the effect throughout the IT department.  When a malpractice case is filed, the hospital must provide detailed information regarding details of the patient treatment at the hospital and every encounter during a specific time frame.  This includes detailed EHR audit trails, copies of the patient’s complete medical records, written policies and procedures, nursing and medical guidelines, and any written documentation that might be on paper regarding the patient.  For most IT departments, we are required to provide a copy of the patient’s EHR audit trail – but it’s not that simple.  Plaintiff attorneys have learned to ask for numerous documents, reports, and written policies and the IT department must understand what they are asking for and what to provide the attorneys.
