Are You Ready for Increased Interoperability and Patient Access?

ONC and CMS have finalized rules on information blocking. These rules were supposed to go into effect on Nov. 2, 2020 but have been delayed until April 5, 2021. At the beginning of November, OCR settled its 10th enforcement action in its HIPAA Right of Access Initiative. The Ciox Health v. Azar decision has invalidated portions of the HIPAA regulations and guidance with respect to patient access. Never before have the requirements around providing access to health information been so confusing or the stakes so high.

In this session, three healthcare privacy and security legal and regulatory experts recap the state of the HIPAA and information blocking rules, discuss the issues that concern healthcare privacy and security professionals the most, and forecast how they expect enforcement to playout in 2021.

Key discussion points

  • What are common areas of noncompliance with the HIPAA right of access?
  • How can providers quickly get into compliance with the information blocking requirements?
  • How to interpret the privacy, security and harm exceptions to information blocking and patient data requests
  • Enforcement update.
